A Langley woman who suffered multiple injuries in a 2016 car accident has been awarded $1.84 million in damages.
In the reasons for judgment, British Columbia Supreme Court Justice Trevor Armstrong said the woman led an active life before the crash, taking ski holidays with her family multiple times a year.
“She is now left spending a lot of time indoors, on her own and she struggles to get quality sleep,” Armstrong said. “It is clear on the evidence that the injuries [the plaintiff] received as a result of the accident have had a profound and long-standing effect on her quality of life.”
The collision occurred at a railway crossing at Glover Road on the Langley Bypass.
The plaintiff, who was a 47-year-old office manager at the time of the incident, suffered headaches and blackouts as as result of the crash. The judge noted that her recovery had been slow due to the fact she suffered issues related to a brain injury and post-concussion syndrome.
Since the crash, the plaintiff can no longer drive on her own and said she is incapable of doing basic household chores.
The defendant alleged the plaintiff could have done more to improve her condition with further treatments and questioned whether the blackouts were related to the crash. However, the judge said in their view the blackouts could reasonably be attributed to the injuries sustained in the crash.
“This is not a case where there are medical opinions presenting a contrary diagnosis,” Armstrong said. “I am satisfied on the balance of probabilities with regard to common sense reasoning that the occurrence of the blackout events stems from the impact of the injuries caused by the defendants negligence.”
